Terms of service.

1. Parties

These Terms are a binding agreement between you (the "Customer," "you," or "your") and DesignSetGo LLC, an Arizona limited liability company ("DesignSetGo," "we," "us," or "our"). Together you and DesignSetGo are referred to as the "parties."

2. Definitions

• "Plugin" means the DesignSetGo Apps WordPress plugin, including its runtime, bridge, in-admin UI, and all components distributed in the official zip, in all current and future versions.
• "Services" means the Plugin together with the designsetgo.dev website, the Riff in-admin AI builder, the @designsetgo/cli command line tool, the @designsetgo/app-client bridge client, the @designsetgo/astro adapter, license management, telemetry, updates, and documentation.
• "Free Tier" means the no-cost capabilities of the Plugin available without an active paid Subscription or Trial: one active app per WordPress site, runtime, manifest validator, HTML uploader, and read-only bridge methods (posts.list/get, pages.list/get, user.current, help.*).
• "Trial" means the 14-day free trial of all Pro features that activates automatically when you complete Freemius opt-in inside the Plugin.
• "Subscription" means a paid annual or monthly subscription to the Pro or Studio tier as described on the pricing page.
• "Site" means a single live WordPress installation reachable at a unique production domain. Local development environments (hostnames ending in .test, .local, or localhost) do not count toward the Site limit of your Subscription.
• "App" means a static HTML, CSS, and JavaScript bundle (with a dsgo-app.json manifest) that you install through the Plugin to run at /apps/{slug} on your Site.

3. The Services

We grant you a non-exclusive, non-transferable, revocable, limited license to install and use the Plugin on Sites that are within your subscription's Site limit, solely for the purpose of operating Apps you own or are authorized to use.

The Plugin is licensed, not sold. Title to the Plugin and all intellectual property rights remain with DesignSetGo. Except for the open-source components listed in Section 14, the Plugin and all related Services are proprietary software distributed under this commercial license. Any GPL, MIT, or other open-source notices that appeared in pre-1.1.0 releases do not apply to the current Plugin runtime or to any Pro feature.

4. Accounts and license keys

To purchase a Subscription you create an account through Freemius, our payment and license-management partner. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly at support@designsetgo.dev if you believe your credentials have been compromised.

A single license key may be activated on up to the number of Sites included in your tier (3 for Pro, unlimited for Studio). Activating the Plugin on a Site beyond your tier's limit is prohibited; we may deactivate excess activations or require you to upgrade.

5. Subscriptions, billing, renewal

Subscriptions are sold on either an annual or monthly billing cycle, at the price listed on the pricing page at the time of purchase. Renewal pricing may differ from introductory or promotional pricing and is the price stated at the time of renewal.

Auto-renewal. Unless you cancel before the end of your current billing period, your Subscription will renew automatically for another period at the then-current renewal rate, charged to your payment method on file. You can cancel auto-renewal at any time in your Freemius account portal.

Taxes. Prices are exclusive of taxes. You are responsible for any sales tax, VAT, GST, or similar tax that applies to your purchase. Where required by law, Freemius collects these on our behalf at checkout.

Failed payments. If a renewal payment fails, we may attempt to recharge your payment method and notify you. If payment remains unresolved, your Subscription will lapse and your Plugin will revert to the Free Tier.

6. Free Trial

When you complete the Freemius opt-in inside the Plugin, a 14-day Trial of all Pro features activates automatically. No credit card or payment method is required to start the Trial. Nothing charges automatically when the Trial ends. On the 15th day, the Pro-gated features deactivate and your installation reverts to the Free Tier. Apps you installed during the Trial remain installed; only the Pro runtime features (CLI deploy, Riff, scheduled jobs, webhooks, dynamic routes, abilities publishing, ai.prompt, write bridge methods) become unavailable until you activate a paid Subscription.

You may only start one Trial per Site. We reserve the right to revoke or shorten Trials we believe are being abused (for example, by creating multiple accounts to extend the Trial period).

7. Cancellation and refunds

You may cancel your Subscription at any time in your Freemius account portal. Cancellation stops future auto-renewal; you retain access to Pro features for the remainder of your current billing period. Refund eligibility is described in our Refund Policy, which is incorporated into these Terms by reference.

8. Acceptable use

You agree not to, and not to permit any third party to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Plugin's closed-source components, except to the extent this restriction is prohibited by applicable law;
• Resell, sublicense, rent, lease, or otherwise commercially redistribute the Plugin or any Pro feature, except as expressly permitted by the Studio white-label terms;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notice in or on the Plugin (the Studio white-label feature is the only permitted means of altering brand presentation, and is subject to its own terms);
• Use the Plugin to send unsolicited bulk email or to run, host, distribute, or facilitate any unlawful, harassing, defamatory, or infringing content;
• Use the Plugin to circumvent or attempt to circumvent any rate limits, license checks, or other technical protections;
• Use the Plugin in a manner that infringes any third party's intellectual property rights, privacy rights, or other legal rights;
• Install Apps that contain malware, cryptominers, spyware, or that exfiltrate end-user data without consent.

9. AI features and provider keys

The Plugin's AI features (Riff, dsgo.ai.prompt, abilities consumption, and similar) route through the WordPress 7.0 Connectors API or, when configured, the optional DesignSetGo-Managed AI Connector. We do not hold, store, or have access to your AI provider API keys when you use the WordPress Connectors path (the dominant case). You are responsible for configuring your own AI provider account (such as Anthropic, OpenAI, or Google), for all charges that your AI provider invoices you, and for complying with that provider's terms of service.

Prompt content and AI responses are processed by your AI provider under your provider's terms. We do not log prompt content or AI responses on our infrastructure when you use the WordPress Connectors path. We may log aggregate counts (such as number of prompts run during a Trial) for billing, support, and product analytics, as described in our Privacy Policy.

If and when the optional DesignSetGo-Managed AI Connector add-on becomes available, separate terms specific to that add-on (including a fair-use cap and an addendum regarding our handling of inference traffic) will apply.

10. Customer-installed Apps

The Plugin is a runtime for static bundles you upload. You are solely responsible for the content, behavior, security, and legal compliance of any App you install, including any App generated for you by an AI tool. We do not review or audit the contents of your bundles, and we make no representation that an installed App is safe, accurate, or fit for any particular purpose. The Plugin's sandbox, content security policy, and permission system are defense-in-depth measures, not guarantees of safety for arbitrary third-party code.

11. Updates and maintenance

We may release Plugin updates from time to time. Updates may add, change, or remove features and may require you to accept additional terms. We use commercially reasonable efforts to give advance notice of material backwards-incompatible changes, but we reserve the right to ship security fixes without notice. You are responsible for keeping the Plugin updated to a supported version.

12. Service availability

The Services are provided on a commercially reasonable best-efforts basis. We do not guarantee uninterrupted access to the licensing server, the Freemius checkout, the designsetgo.dev website, or any third-party service the Plugin depends on. Brief outages, scheduled maintenance, and degradations of third-party services (including AI providers, WordPress.org, and CDN providers) are an expected part of normal operation. The Plugin's core runtime is designed to continue operating without a live connection to the licensing server.

13. Warranty disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING (WITHOUT LIMITATION) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Open-source components

The following components are distributed under permissive open-source licenses and are not covered by the proprietary-license terms above:

• @designsetgo/app-client (the bridge client library): MIT License.
• @designsetgo/cli (the command line tool): MIT License. The deploy capability is enforced server-side by the Plugin's Pro feature gate; the binary itself is openly published on npm.
• @designsetgo/astro (the Astro adapter): MIT License.
• Public starter templates at github.com/DesignSetGo: MIT License unless a specific template specifies otherwise.

The Plugin runtime itself (everything in the installed designsetgo-apps/ directory) was previously distributed in part under GPL but, as of version 1.1.0, is licensed only under these commercial Terms. Any open-source license notices that appeared in pre-1.1.0 distributions do not extend to the current Plugin or to any Pro feature.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DESIGNSETGO OR ITS OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING (WITHOUT LIMITATION) DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF DESIGNSETGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DESIGNSETGO'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU ACTUALLY PAID TO DESIGNSETGO FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

16. Indemnification

You will defend, indemnify, and hold harmless DesignSetGo and its officers, employees, agents, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Services in violation of these Terms or applicable law, (b) any App you install or distribute, (c) your AI provider account, the content of prompts you submit, or the content of responses you receive, or (d) your violation of any third party's intellectual property, privacy, or other rights.

17. Termination

You may stop using the Services at any time by canceling your Subscription and uninstalling the Plugin. We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms (including the Acceptable Use rules in Section 8), if your payment fails, or if we are required to do so by law or by a regulator. On termination, all licenses granted to you under these Terms end immediately, except that the Free Tier license described in Section 3 continues to apply to any installation that does not depend on Pro features.

Sections that by their nature should survive termination (including Sections 10, 13, 14, 15, 16, 17, 19, 20, 21, and 22) will survive.

18. Modifications to these Terms

We may update these Terms from time to time. If we make material changes, we will give you reasonable notice through the Plugin's admin UI, by email to the address associated with your Freemius account, or by posting a notice on designsetgo.dev. Continued use of the Services after the effective date of the updated Terms constitutes acceptance of those Terms. If you do not agree to a material change, your sole remedy is to cancel your Subscription and stop using the Services.

19. Governing law and venue

These Terms are governed by, and construed in accordance with, the laws of the State of Arizona, USA, without regard to its conflict-of-laws principles. The parties agree that the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and the parties consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

20. Informal dispute resolution

Before filing a claim, the parties will attempt in good faith to resolve any dispute through informal negotiation. You agree to first contact us at support@designsetgo.dev with a written description of the dispute. If the dispute is not resolved within thirty (30) days of that notice, either party may pursue formal proceedings as described in Section 19.

21. Miscellaneous

Entire agreement. These Terms, together with the Refund Policy and the Privacy Policy, constitute the entire agreement between you and DesignSetGo regarding the Services and supersede any prior or contemporaneous agreements.

Severability. If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in full force.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any prohibited assignment is void.

Force majeure. Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control (including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or power failures, and pandemics).

Notices. Legal notices to DesignSetGo must be sent by email to legal@designsetgo.dev with a copy by certified mail to the address listed on our contact page. Notices to you may be sent to the email address associated with your Freemius account.

Relationship. The parties are independent contractors. These Terms do not create any agency, partnership, joint venture, or employment relationship.

U.S. government end users. The Services are "commercial computer software" as defined in 48 C.F.R. 2.101 and are licensed to U.S. government end users only as commercial items and with only those rights granted to all other end users under these Terms.

Export. You agree to comply with all applicable U.S. and foreign export-control laws and not to use the Services in any country subject to a U.S. trade embargo.
